Upon receipt of a valid counter-notification, we may restore the removed content. Unless the original complainant files a lawsuit seeking a court order to keep the content removed.

3. Repeat Infringer Policy

MOBSEAR Gallery takes copyright infringement seriously and, in appropriate circumstances, terminates the accounts of repeat infringers, who have received multiple DMCA notices. Our rules enforce a strict policy against repeat infringers. If a user repeatedly violates copyright laws by posting infringing content, we may:

  • Issue warnings or temporary suspensions.
  • Permanently terminate accounts of repeat offenders.
  • Restrict access to our platform to prevent further violations.

4. False Claims & Legal Consequences

Submitting false DMCA notices or counter-notices can result in legal consequences. Anyone who knowingly misrepresents that content is infringing or was wrongly removed may be liable for damages, including court costs and attorney fees under Section 512(f) of the DMCA. Users are encouraged to ensure the accuracy of their claims before submitting them.
